1. ACCEPTANCE OF TERMS

By accessing or using the NEES website (nees.fun) or by placing an order, you unconditionally agree to be bound by these Terms and Conditions. If you do not agree, please do not use this website. NEES reserves the right to modify these Terms at any time without prior notice. Continued use of the website after any changes constitutes acceptance of the revised Terms.

2. PRODUCTS, AVAILABILITY AND PRICING

All products listed on the NEES website are subject to availability. NEES reserves the right to modify product listings, descriptions, and prices at any time without prior notice. The price displayed at the time of order placement and checkout confirmation shall be the price charged for that specific order.

In the event of a pricing error due to a technical or typographical mistake, NEES reserves the right to cancel the affected order and issue a full refund, without any further liability to the customer.

⚠  Product images are for representational purposes only. Actual product colour, print tone, or finish may vary slightly due to photography lighting, screen display calibration, or manufacturing batch differences. Such variation does not constitute grounds for return or refund.

3. PREPAID ORDERS ONLY

NEES operates on a prepaid-only basis. All orders must be paid in full at the time of checkout. Cash on Delivery (COD) is not available. By placing an order on NEES, you unconditionally agree to this payment condition.

4. ORDER CONFIRMATION AND CONTRACT

Your order is confirmed upon receipt of an order confirmation message via SMS, WhatsApp, or Email from NEES. A legally binding contract between the customer and NEES is formed only upon dispatch of the product, not merely upon order placement or payment. NEES reserves the right to reject, cancel, or limit any order at its sole and final discretion, including cases of suspected fraud, pricing errors, stock unavailability, or violation of these Terms.

5. INTELLECTUAL PROPERTY

All content on the NEES website including but not limited to the NEES logo, brand name, product designs, photographs, graphics, website layout, copy, and marketing materials is the exclusive intellectual property of NEES and is protected under the Trade Marks Act, 1999 and the Copyright Act, 1957 of India.

You are strictly prohibited from copying, reproducing, modifying, distributing, or commercially exploiting any NEES content without prior written permission. Unauthorised use may result in civil and/or criminal proceedings.

6. PROHIBITED USE

By using this website, you agree not to:

  • Use the website for any unlawful, fraudulent, or harmful purpose.

  • Attempt to gain unauthorised access to any part of the website or backend systems.

  • Resell NEES products commercially without a prior written reseller agreement.

  • Place orders with false, misleading, or unverifiable information.

  • Initiate chargebacks or payment disputes without first attempting resolution through NEES customer support.

7. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable Indian law, NEES shall not be liable for any indirect, incidental, consequential, or punitive damages arising from use of or inability to use this website or NEES products. NEES total liability in any case shall not exceed the purchase price paid for the specific product giving rise to the claim.

NEES is not responsible for any injury, property damage, or harm resulting from misuse of the product, use by persons under 18 years of age, or use in violation of any applicable laws.

⚠  NEES lighters contain flammable gas and produce an open flame. Safe and responsible use is the sole responsibility of the buyer. NEES disclaims all liability for accidents, damage, or injury arising from improper, reckless, or unlawful use.

8. CHARGEBACKS AND PAYMENT DISPUTES

If a customer initiates a chargeback or payment dispute with their bank or payment provider without first attempting resolution through NEES customer support, NEES reserves the right to take appropriate legal and commercial action, including blacklisting the account and pursuing recovery of any disputed amount along with all associated costs and legal fees.

9. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the competent courts in Bhopal, Madhya Pradesh, India.
